DUTIES: As Depot Legal Officer, handles legal and factual problems with wide latitude for the exercise of independent judgment, for the Depot and its tenant activities. Advises and assists in the negotiation and preparation of contracts, contract clauses and other legal documents. Litigation, contracts, and claims handled have impact on the public in terms of money involved, on relations with state and local government agencies, national defense, private interests, agency authority, operations, procedures, practices; many cases and legal practices handled have a far reaching effect on the parties involved or on the governments prestige which is often irreparable. Some problems handled have few or conflicting precedent cases to be interpreted and applied. Decisions relate to sensitive matters, significant legal precedents and matters in which there is interest on the part of the public (e.g., environmental pollution problems, labor relation problems, Equal Employment Opportunity matters, and bids on contracts), which may have economic, social, and political impact. Handles matters with the view of preventing litigation. Maintains liaison with the local bar and its associations to keep them informed of policies and procedures involved in depot legal functions and in turn advises the command of local legal developments. Advises Commander and key personnel on questions of substantive and remedial law or administrative policy involved in the operations of the depot and in contacts with industry, private and professional associations, state, local, or the general public. Answers questions on common law, administrative, criminal, and civil law, including questions covered by interpretations of the Comptroller General and other legal authority. Renders some decisions based on legal theory and analysis when no legal precedents exist, such as cases dealing with environmental matters, EEO complaints, labor relations, and contracts. Decisions form the basis for depot policy, justification for the conduct of litigation on behalf of the depot by the Department of Justice, settlement of claims against the government brought by contractors and private citizens, terms of contracts and awarding and enforcement of contracts. Civilian Personnel/Labor Management Relations/EEO: Serves as the Army Labor Counselor. Advises the Depot Commander, the Civilian Personnel Advisory Center and other management officials on legal aspects of disputes between employees and/or employee union organizations and management. Represents the depot or tenant activity in such disputes when they are presented as: (1)unfair labor practices and submitted to the Federal Labor Relations Authority; (2) prohibited personnel practices and submitted to the Merit Systems Protection Boards Special Counsel; (3)adverse actions and appealed to the Merit Systems Protection Board or to arbitration; (4)grievances and taken to arbitration; (5)equal employment opportunity complaints and submitted to the Equal Employment Opportunity Commission; or (6) negotiation impasses submitted to the Federal Service Impasses Panel. Provides local guidance to depot management officials, including contract negotiating teams, on matters pertaining to public and private section labor relations, unions, union contract negotiations and government contractors. Maintains contact with contractors and unions to assure compliance with contract, statutory, and regulatory requirements. Keeps informed of collective bargaining agreements with contractors, expirations dates and other problem issues or differences, which could result in work stoppage and advises contracting officer. Investigates complaints of contractor employees and if violations exist, advises contractor, assuring remedial action is taken. If action is not taken, furnishes facts to HQ, AMC which may result in placing contractor on debarred Bidders List. QUALIFICATION REQUIREMENTS: Extensive experience independently researching statutes, case law, regulations, Legal Precedents, and administrative procedures and departmental policies. The candidate possesses the skills and abilities to gather all relevant facts, independently research, analyze, and interpret laws, regulations, legal precedents, administrative procedures, and policies to render thorough and sound accurate legal advice on a variety of legal issues. Extensive experience communicating with high ranking military and/or civilian managers, supervisors, and technical staff. Prepares and presents formal and informal oral and written reports and briefings relative to assigned projects and studies. Makes formal presentations to organizational directors. Candidate has extensive experience and skills preparing and presenting cases before a federal or military administrative decision making body. Possesses significant practical experience that would demonstrate a high level of proficiency in oral communications and advocacy. This experience is supported by specific examples. The candidate demonstrates significant experience or ability in the following areas: Ability to provide accurate legal advice on complex questions of Federal Law involving Contract Law, Installation Law, Ethics/Standards of Conduct, Labor/Personnel and EEO, Information Access, Fraud, Legal Assistance, Litigation and Safety & Environmental Law. |
